Take a look at this article. There was another concrete facility (a precast plant in Pennsylvania) subject to USEPA enforcement. This time, instead of stormwater or process water violations, this one is for failure to report for several years under EPCRA Toxic Release Inventory reporting requirements.

The positive aspect to this? The facility utilized the USEPA Audit Policy, and received 100% mitigation for the financial penalty that was levied against the company, over $325,000 all together!

These guys did the right thing and saved themselves a good amount of money. They self-reported after uncovering reporting violations rather than risking being caught by the USEPA. Had they not self-reported, and been caught in these violations, the fines would have been at least $326,583, and most likely would have been much higher.

Could this happen to you? First, you need to know where you stand with ALL regulatory programs - including TRI reporting. Second, if you do uncover potential violations, consider careful use of the USEPA Audit Policy of self-disclosure. It might save you a considerable amount of money as fines. This is something you really need to consider. It can, and has, saved people lots of money. But be warned, if you report something, you better be ready to fix it. You’ll likely need to invest both time and money fixing the issues. In some ways, it’s a get out of jail card, but, it only works once.

The USEPA Audit Policy can be a great thing when applied correctly, and it's worth considering if you have any potential regulatory compliance issues.
